Terms of Service

1. Acceptance of Terms
By requesting services from, scheduling an estimate with, or engaging Apex Grounds Co. ("Company," "we," "us," or "our") in any capacity — including through our website at apexgroundsco.com, by telephone, or in person — you ("Customer," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not request or use our services.
These Terms of Service apply to all residential and commercial customers and govern the relationship between you and Apex Grounds Co. for all landscaping, lawn care, and grounds maintenance services provided.
2. Description of Services
Apex Grounds Co. provides professional lawn care, landscaping, and grounds maintenance services to residential and commercial customers in Tangipahoa, St. Tammany, and Livingston Parishes, Louisiana. Our services include but are not limited to:
- Lawn mowing, edging, and maintenance
- Landscaping design and installation
- Sod installation and turf management
- Fertilization, weed control, and pest control
- Shrub and hedge trimming
- Mulch and gravel installation
- Drainage solutions
- Seasonal cleanup services (spring, fall, storm)
- Pressure washing
- Commercial grounds management and HOA services
- Other grounds care services as agreed upon in writing
The specific scope of services for each engagement is defined at the time of estimate and confirmed prior to commencement of work. We reserve the right to decline any service request at our discretion.
3. Estimates and Pricing
All estimates provided by Apex Grounds Co. are based on an in-person assessment of your property. We do not provide binding quotes by phone or through our website without an on-site visit. Estimates are provided at no charge and with no obligation.
Estimates are valid for 30 days from the date of issuance. Pricing is subject to change after 30 days or if the scope of work changes materially from what was assessed at the time of the estimate. Additional work requested beyond the original scope will be quoted separately before being performed.
Recurring maintenance pricing may be adjusted with 30 days' written notice to reflect changes in labor, material costs, fuel costs, or the condition of the property.
4. Payment Terms
Payment terms are established at the time of service agreement. For residential recurring maintenance, payment is typically due upon completion of each service visit unless otherwise arranged in writing. For installation and project work, a deposit may be required prior to commencement, with the balance due upon completion.
Late payments may be subject to a late fee of 1.5% per month on the outstanding balance. Accounts more than 30 days past due may result in suspension of service until the balance is paid in full. Customer is responsible for any collection costs, including reasonable attorney's fees, incurred in the collection of overdue balances.
5. Cancellation Policy
Recurring maintenance services may be cancelled by either party with 14 days' written notice. Notice may be provided by email or text message to the contact information on file.
One-time or project services cancelled with less than 48 hours' notice may be subject to a cancellation fee equal to 25% of the estimated project cost to cover scheduling and mobilization expenses.
Weather-related delays: We reserve the right to reschedule service visits due to severe weather, including heavy rain, lightning, or tropical storm or hurricane warnings. We will notify you as soon as practicable and reschedule at the earliest available opportunity. No cancellation fee applies to weather-related rescheduling by the Company.
Deposits paid for installation or project work are non-refundable once materials have been ordered or work has commenced.
6. Customer Responsibilities
Customer agrees to:
- Provide accurate information about the property at the time of estimate
- Disclose any underground utilities, irrigation systems, septic systems, buried cables, or other subsurface features that could be affected by service
- Ensure reasonable access to the property on scheduled service days, including unlocked gates and removal of vehicles or obstacles blocking work areas
- Secure pets indoors or in a safe area during service visits
- Notify us of any changes to the property or service requirements prior to the scheduled visit
Apex Grounds Co. is not liable for damage to undisclosed underground features or for delays caused by inaccessible work areas.
7. SMS Communications
By providing your phone number and consenting to SMS communications via our contact form or otherwise in writing, you agree to receive text messages from Apex Grounds Co. regarding your service inquiry, estimate scheduling, service confirmations, and follow-up communications.

- Message and data rates may apply depending on your carrier and plan
- To opt out at any time, reply STOP to any message from us
- To request help, reply HELP
- SMS consent is not required as a condition of purchasing any service
- We do not share your phone number or SMS consent with third parties for marketing purposes
Carriers are not liable for delayed or undelivered messages.
8. Limitation of Liability
Apex Grounds Co. carries general liability insurance and takes reasonable precautions to protect your property during all service visits. In the event of damage caused directly by our negligence, we will work with you in good faith to assess and address the damage.
To the maximum extent permitted by applicable law, the total liability of Apex Grounds Co. for any claim arising out of or related to services provided shall not exceed the total amount paid by Customer for the specific service giving rise to the claim in the three months preceding the incident.
We are not liable for: (a) damage to undisclosed underground utilities, irrigation lines, septic systems, or other subsurface features; (b) pre-existing conditions in turf, plants, or structures; (c) acts of God, severe weather, or events beyond our reasonable control; (d) indirect, incidental, or consequential damages of any kind.
Results of lawn care and landscaping services depend on many factors outside our control, including soil conditions, weather patterns, pest pressure, and customer maintenance between service visits. We do not guarantee specific outcomes or results.
9. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law provisions. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Tangipahoa Parish, Louisiana.
If any provision of these Terms of Service is found to be unenforceable, the remaining provisions shall remain in full force and effect.
10. Changes to These Terms
Apex Grounds Co. reserves the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the revised terms. We encourage you to review this page periodically.
